Current Rule proposals include:
Aligning licensing procedures with the updated version of the Texas Racing Act effective on September 1, 2023.
Increasing training facility equine and human safety protocols.
Modernizing e-wagering platforms to allow a more diverse audience to participate in wagering activities at licensed racetracks.
PROPOSED RULE CHANGE UPDATE:
Proposed Rules – the proposed rules presented at the October Commission & Rules Committee meeting that involved licensing and training facility operations were posted in the November 17 Edition of the Texas Register.
A correction to Rule 311.2 is pending publication in the Texas Register (updated link will be posted when available).
The Texas Register posting is required for 30 days for public comment; therefore, the final version of the rules will not be presented for adoption until the February 2024 Commission meeting.
The e-wagering rule proposal is still under review by the Governor’s office.

NOTICE ON PUBLIC COMMENTS RECEIVED ON THE PENDING DRAFT RULE AMENDMENTS
PUBLIC COMMENTS RECEIVED FROM OCTOBER 18-25, 2023, INDICATED THAT THE INITIAL DRAFT OF LICENSING RULES WAS UNCLEAR AS TO THE PURPOSE OF THE 31 DAY TIMELINE (THIS TIMELINE WAS MEANT AS A DUE PROCESS NOTICE FOR APPLICANTS WHO MAY HAVE A DISQUALIFYING CRIMINAL BACKGROUND, NOT A WAITING PERIOD FOR ALL APPLICANTS).
BASED ON THE FEEDBACK, THE AGENCY HAS REVISED THE DRAFT LICENSING RULE WHILE MAINTAINING THE ALIGNMENT WITH STATUTORY INTENT AND REPOSTED THE PROPOSED RULE FOR PUBLIC COMMENT.
CONSTRUCTIVE COMMENTS AND ALTERNATE LANGUAGE PROPOSALS ARE WELCOME ON THE PROPOSED RULE AMENDMENTS.
